By accessing or using BoingyBooks ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
BoingyBooks is operated by BooksAndGuidesPro ("Company", "we", "us", or "our"). These Terms apply to all visitors, users, and others who access or use the Service, including buyers who purchase without creating an account (guest checkout).
BoingyBooks is an interactive read-along book creation and publishing platform that allows users to:
To create and sell books, you must register for an account. Buyers may purchase books as guests without an account; a free account will be automatically created using the email address provided at checkout so you can access your purchased books at any time.
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. If your account is terminated, access to purchased books may be revoked.
BoingyBooks offers three subscription plans, each managed through MemberPress:
You may upgrade or downgrade your plan at any time through your MemberPress account. Downgrades take effect at the end of your current billing period. If you downgrade below the requirements of your current usage, some features may become unavailable until you upgrade again.
You retain full ownership of all content you create and upload to BoingyBooks, including text, images, and audio ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content solely as necessary to provide and promote the Service.

We reserve the right to remove any content that violates these guidelines without notice.
Given that BoingyBooks is designed for creating children's educational content, all published marketplace content must be appropriate for children of all ages unless specifically marked otherwise. We reserve the right to remove content that we determine is not suitable for a general audience.
To sell books on the BoingyBooks marketplace, you must:

Sellers may change their price at any time from the Seller Dashboard. Price changes apply to future purchases only and do not affect existing sales.
When a buyer purchases your book, the sale amount is split as follows:

Payouts are processed automatically by Stripe Connect and deposited directly into the bank account you linked during seller onboarding. Stripe's standard payout schedule is:
We do not hold or manage seller funds. All payments flow directly through Stripe. We are not responsible for payout delays caused by Stripe, your bank, or incomplete Stripe account information.
Books can be purchased by anyone, with or without a BoingyBooks account:
All payments are processed securely through Stripe. BoingyBooks does not store your credit card information.
Due to the digital nature of our products, all sales are generally final. Refunds may be issued at our sole discretion in the following cases:
To request a refund, contact us at support@booksandguidespro.com within 14 days of purchase. If a refund is issued, the seller's payout for that sale will be reversed.
The Service and its original content (excluding User Content), features, and functionality are owned by BooksAndGuidesPro and are protected by copyright, trademark, and other intellectual property laws. The BoingyBooks name, logo, and bouncing ball technology are proprietary to BooksAndGuidesPro.
You represent and warrant that you have all necessary rights to the content you upload, including text, images, and audio. You are solely responsible for ensuring your content does not infringe on third-party rights. If we receive a valid copyright complaint regarding your content, we may remove it without notice.
When you purchase a book, you receive a personal, non-transferable license to read and interact with that book through the BoingyBooks platform. You may not redistribute, resell, copy, or share purchased books. Personal narrations you record are for your private use only.

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding your personal information. By using guest checkout, you consent to the creation of an account using the email address you provide.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any part of the Service at any time.
We do not endorse, verify, or guarantee the accuracy, completeness, or quality of any User Content, including books sold on the marketplace. Purchases are made at your own discretion and risk.
We make no guarantees about the amount of income sellers will earn through the marketplace. Earnings depend on factors including book quality, pricing, marketing, and buyer demand.
To the maximum extent permitted by law, BooksAndGuidesPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
You agree to indemnify and hold harmless BooksAndGuidesPro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another party.
Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitrations are not permitted.
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page and updating the "Last Updated" date. For significant changes (such as fee adjustments), we will also notify registered users by email. Your continued use of the Service after changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
